Whether firms had to pay staff minimum wage if they did not work during the covid-19 lockdown but were available to do so, was argued in an Employment Court test case today. A full Employment Court panel heard an appeal from Gate Gourmet, which was found by the Employment Relations Authority to have breached minimum wage rules during the covid-19 lockdown. In a determination dated June 29, ERA member Geoff O’Sullivan ordered the company to pay its workers the difference between what it paid over the lockdown and the minimum wage...
