Ebert liquidators lose $2.4m clawback claim

The liquidators of Ebert Construction have lost a bid to claw back $2.4 million from Wakefield Plant, an associated company not part of the liquidation.  Ebert Construction was moved into liquidation in July 2018. According to BDO liquidators Iain Shephard and Jess Kellow, creditors are owed $123 million in the liquidation, although this figure has not been reviewed. Under the clawback rules, liquidators can increase the pool of money to be shared among creditors if they prove historic transactions are “voidable” by meeting a legal test. ...
