UPDATE ON INDEPENDENT EXPERT FOR SKYCITY ADELAIDE

SkyCity Entertainment Group Limited (SkyCity) advises that the South Australian Liquor and Gambling Commissioner (Commissioner) has approved the appointment of Kroll Australia Pty Limited as the independent expert for SkyCity Adelaide Pty Limited (SkyCity Adelaide), the operator of the SkyCity Adelaide casino.

As previously announced, on 29 May 2023 the Commissioner issued a direction notice to SkyCity Adelaide under section 10 of the Gambling Administration Act 2019 (SA) (Direction), requiring SkyCity Adelaide to appoint a suitably qualified independent expert approved by the Commissioner to:

• review SkyCity Adelaide’s anti-money laundering and counter-terrorism financing (AML/CTF) and host responsibility enhancement programmes and, if required, make amendments to those enhancement programmes;

• monitor the implementation of those enhancement programmes by SkyCity Adelaide and SkyCity Adelaide’s compliance with its AML/CTF and gambling harm minimisation obligations; and

• report to the Commissioner in relation to the above matters.

The Direction was issued following the Commissioner’s decision in February 2023 to place the Hon Brian Martin AO KC’s independent review into SkyCity Adelaide on hold pending the resolution of the civil penalty proceedings filed by the Australian Transaction Reports and Analysis Centre against SkyCity Adelaide in December 2022. Mr Martin was appointed by the Commissioner in July 2022 to undertake an independent review under section 22(2) of the Casino Act 1997 (SA) into the suitability of SkyCity Adelaide to continue to hold the SkyCity Adelaide casino licence and the suitability of SkyCity to continue to be a close associate of SkyCity Adelaide in light of interstate inquiries into various Australian casino operations at the time.

The Commissioner has advised that the appointment of an independent expert will provide an independent perspective of SkyCity Adelaide’s AML/CTF and host responsibility enhancement programmes and an additional layer of assurance.

SkyCity and SkyCity Adelaide will continue to work pro-actively and cooperatively with the Commissioner and Kroll Australia Pty Limited.
